United States v. Quinnones

Utilizing the “much-criticized categorial approach,” the Third Circuit held that the Pennsylvania crime of assault by prisoner (after the defendant threw excrement and other such undesirables) is not a crime of violence under the United States Sentencing Guidelines’ career offender provision. The District Court had applied the enhancement at sentencing. The Third Circuit reversed and remanded for resentencing.
