Motion to Quash Results in Dismissal of Charges in Drug Possession Case

A criminal defense attorney hired Sullivan | Simon to write a motion to quash charges against his client involving possession with the intent to deliver a controlled substance in Pennsylvania’s Court of Common Pleas. The attorney’s client was facing more than 40 years in prison and the sentencing guidelines alone recommended at least five years in prison. 

Not only did the judge grant the motion to quash the charges and dismiss all charges, but the prosecutor did not even argue otherwise. After reading our brief, the prosecutor agreed that the charges should be dismissed.
