Sullivan|Simon’s argument could save client from serving up to two decades in jail.

Matt Sullivan assisted in an appeal challenging a criminal defendant’s sentence for attempted murder. The case was on appeal in the Pennsylvania Superior Court from the denial of PCRA relief. Matt took advantage of recent changes in the law, arguing that PCRA counsel was ineffective for failing to assert a claim that the defendant was sentenced based on facts the jury had not found beyond a reasonable doubt.

The Superior Court agreed with Matt’s argument. The result could save the defendant up to 20 years in jail.
