In Failor v. FedEx Ground Package System, Inc., the Pennsylvania Superior Court vacated an order from the Court of Common Pleas that had dismissed a slip-and-fall complaint based on 42 Pa.C.S. ยง 5322(e) and forum non conveniens. The injury occurred at a FedEx site in Maryland, but the injured employee lived in Pennsylvania and was about to bring a shipment to Pennsylvania when the injury occurred. The Superior Court found that both public and private factors favored honoring the plaintiff’s choice of forum.
