In Commonwealth v. Brown, the jury credited the defendant’s testimony and acquitted him of homicide and related charges. However, he was convicted of several violations of Pennsylvania’s Uniform Firearms Ac and sentenced to 16 to 32 years of incarceration. On appeal, the Pennsylvania Superior Court affirmed and rejected the argument that the trial court essentially sentenced the defendant to a third-degree murder penalty.
