The Zitneys sued a host of drug manufacturers after Ms. Zitney developed tardive dyskinesia caused by her use of medicine made by Wyeth LLC. The trial court granted summary judgment in favor of the drug manufacturer defendants. In Zitney v. Wyeth LLC, the Superior Court affirmed the trial court’s order, ruling, because the Zitneys conceded that the defendants fulfilled their duty to provide content-appropriate warning labels in the medicine’s packaging, the trial court properly found that the defendants had not breached their duty to the Zitneys.
