The New Jersey Appellate Division vacated the defendant’s convictions for sexually assaulting two children. The Court ruled that the trial court erred when it denied the defendant’s motion to sever the cases because the evidence regarding one case would not have been admissible at a separate trial for the other. “Simply put, the trial court denied defendant’s severance motion without conducting the carefully-focused analysis required by N.J.R.E. 404(b).”
