For those of us, who believe climate change is not fake news, the 3rd Circuit delivered a heartening opinion in Sierra Club v. U.S. EPA. The 3rd Circuit ruled that the Environmental Protection Agency’s approval of new Pennsylvania National Ambient Air Quality Standards was arbitrary and capricious. The Court remanded to the agency with instructions that it develop “enforceable pollution controls in accordance with its legal obligations.”
