4/20/2020 — The appellant filed a complaint in confession to repay the money loaned on a note to cover debts the appellee owed to a bookie for gambling losses. After a bench trial, the court ruled in favor of the appellant, but in response to the appellee’s post-trial motion, the lower court granted a JNOV in his favor. On appeal, after determining the issue was preserved, the Superior Court affirmed. Under 73 P.S. 2031, all gaming contracts are void. Here, since the note was executed to cover gambling debts, it was void and unenforceable.
