The Pennsylvania Superior Court dealt with an issue of first impression: Does Rule 1.6 of the Rules of Professional Conduct create a “self-defense” exception to the attorney-client privilege and the work-product doctrine where the attorney faces a legal claim or disciplinary charge? The Court held that the privileges yield when the attorney is accused of impropriety and must use the privileged information in his own defense.
