The Pennsylvania Commonwealth Court affirmed the agency’s decision to deny KPMG’s bid protests. The Pennsylvania Department of Human Services (DHS) issued a Request for Proposal (RFP) seeking proposals for comprehensive business planning services to support a range of activities within the Information Technology (IT) program project delivery services. DHS received two submissions—one from KPMG and one from Public Consulting Group, Inc. (PCG). DHS awarded the contract to PCG. KPMG filed two bid protests with DHS’s Director, who denied the bid protests in a final agency determination. KPMG then filed a petition for review with the Commonwealth Court, which affirmed. The Court concluded that “PCG provided DHS with adequate information upon which DHS could be assured that PCG would perform the contract according to the RFP’s specified requirements and that PCG did not obtain an unfair competitive advantage.”
