In re Protest for Contract Award for Project A1150-08, Hall Construction Co., Inc. (Hall) appealed from the final agency decision of the New Jersey Division of Property Management and Construction (DPMC) rejecting Hall’s bid protest and awarding the contract to a competitor. First, the Appellate Division dismissed the appeal as moot. The Court ruled that, aside from the substantial work on the Project already performed by the competitor and its numerous subcontractors, as well as large sums expended, setting aside the award of the contract would severely impact the Project, jeopardize the work already completed, and risk damage to the historic structure, which was being renovated. Further, the Court found no merit in Hall’s arguments and concluded that the administrative agency’s final decision was not arbitrary, capricious, or unreasonable and was supported by substantial credible evidence.
