The New Jersey Appellate Division invalidated a 2017 amendment to N.J.A.C. 17:2-6.5, which governs accidental disability pensions for public employees. The amendment’s definition of “willful negligence” extended the statute beyond its intended meaning, and thereby disqualified public employees, who are properly qualified, from receiving accidental disability benefits.
