The Superior Court confronted an Anders brief while reviewing In re Adoption of B.G.S. There, a couple broke up, and, a short time later, the woman learned she was pregnant. She never told the father and put the child up for adoption. After the child was adopted, the mother told the father about his child’s existence. The father contacted the adoption agency but was given no information. The agency filed to terminate his parental rights, which the Orphans’ Court granted. On appeal, the Superior Court held that there were issues of merit and ordered counsel to file an advocate’s brief to determine if the father had actually made reasonable, good faith efforts to maintain a relationship with the child.
