In Commonwealth v. Nunez, the Superior Court issued its second opinion of the week regarding the Drug Overdose Response Immunity Act. The Court again found that the Act did not provide immunity to the defendant. This time, the Court reasoned that the person who called 911 — a restaurant employee — was not reporting an overdose, but rather an uncooperative customer. Because the 911 call was not made for the purpose of reporting a potential overdose, the defendant was not entitled to the Act’s grant of immunity.
