In Assoc. NJ Rifle and Pistol Clubs v. Att’y Gen. NJ, the 3rd Circuit ruled that, because a prior panel had reached the ultimate question of the case—was a statute constitutional—whether the District Court applied the standard for the summary judgment phase or the preliminary injunction phase was not critical.
