In Harris v. Unemp. Comp. Bd. of Rev., the Pennsylvania Commonwealth Court dealt with the same operative facts and parties as in No. 401 C.D. 2020. Here, the Court held that the claimant’s appeal from the Unemployment Compensation Referee to the Unemployment Compensation Board of Review should have been permitted to proceed nunc pro tunc. The Court held that the identity theft perpetrated against the claimant was a unique and compelling factual circumstance warranting nunc pro tunc relief.
