The 3rd Circuit affirmed the District Court’s ruling that Section 1513 of Pennsylvania’s Race Horse Development and Gambling Act, which prohibits people, who have business interests in a business that has gaming licenses, from making political contributions. The 3rd Circuit held that the statute violated the 1st Amendment and could not survive strict scrutiny — or even intermediate scrutiny.
