Commonwealth v. Larkin

In Commonwealth v. Larkin, the Superior Court (en banc) first determined that though Larkin included both dockets on his notice of appeal, it would not quash the appeal because the order informing Larkin of his appellate rights stated, “Petitioner has thirty (30) days from the date of this order to file an appeal.” The Court then affirmed the trial court’s dismissal of the untimely PCRA petition.
