The Pennsylvania Commonwealth Court considered Cent. Dauphine Sch. Dist. v. Hawkins on remand from the Pennsylvania Supreme Court. The Supreme Court ordered the Court to consider the case consistently with Easton Area School District v. Miller, 232 A.3d 716 (Pa. 2020). The dispute centered on 65 P.S. § 67.708(b)(1)(i), s section of Pennsylvania’s Right To Know Law, which exempts from public access a record the disclosure of which “would result in the loss of Federal or State funds by an agency of the Commonwealth.” At issue was a video from a school bus that could disclose the names and identities of the students on the bus. The Commonwealth Court found that the video requested was not exempt from disclosure and ordered the video to be redacted and released.
