The Third Circuit affirmed the Board of Immigration Appeals (BIA) order that dismissed the petitioner’s appeal after he did not file a brief in support of his appeal of the Immigration Judge’s removal order. The Court ruled that the BIA’s decision was neither arbitrary nor irrational. Moreover, the Court could not consider the new arguments that the petitioner raised for the first time.
