In Commonwealth v. Robinson, the Superior Court ruled that the trial court did not err in denying the defendant’s pretrial motion for a continuance to obtain DNA testing on a sweatshirt. The Court held that the circumstances of the case did not include a reasonable argument advanced by the defense that someone other than the defendant committed the murder in question.
