State v. Ghigliotty

#Frye #ToolmarkIdentification

04/20/20- In this appeal, the Court addressed the novel issue of whether a firearms toolmark identification expert’s use of untested three-dimensional computer imaging technology known as BULLETTRAX, in conjunction with the traditional technique of comparing evidence and test bullets using a comparison microscope, requires that a Frye hearing be held to establish the scientific reliability of the technology. In a lengthy opinion, the Court affirmed the trial court’s ruling that a Frye hearing was necessary.
