The New Jersey Appellate Division issued two SkyZone-arbitration opinions in a single day. Here, the arbitration provision contained a severability clause and a clause that the arbitration would be heard by JAMS arbitration services. But JAMS was not available to conduct the arbitration so the plaintiff argued that the entire arbitration provision is void. The Appellate Division disagreed and held that the validity of the other provisions was a scope-of-arbitrability question that, pursuant to the terms of the agreement, had to be presented to the arbitrator. The Court also held that the two defendants that were not SkyZone affiliates could not be compelled to arbitration.
