The Pennsylvania Commonwealth Court heard an appeal from the trial court’s order sustaining preliminary objections concerning subject matter jurisdiction. The issue arose out of a dispute between a municipality and its former police chief over health care costs for the retired police chief. The Commonwealth Court affirmed the trial court’s order dismissing the action because the former police chief failed to abide by the relevant collective bargaining agreement and the Public Employee Relations Act’s mandatory grievance and/or arbitration procedures.
